W.Va. Solution found in house fire that changed hydrant rules

charleston, W.Va.. (WSAZ) – West Virginia American Water Company and a Charleston homeowner have reached a settlement regarding a May 2023 house fire, according to court records and the homeowner’s attorney, Mike Hissam.

On May 5, 2023, a fire destroyed Ric Cavender’s home in the 800 block of Chester Road in Charleston. Fire crews arriving at the scene said three fire hydrants did not produce enough water pressure to combat the flames.

This fire triggered the WSAZ Investigation, False Safety, which led to a new state law that would strengthen hydrant inspections, regulations and reliability.

News of the settlement will come Friday, when attorneys are scheduled to discuss how the deal will be structured, according to Hissam and court records. A court transcript lists that hearing as including a motion to compel settlement.

Hissam told WSAZ that both sides reached an agreement this summer. As a result, his client said Cavender would receive money from West Virginia American Water, but Hissam would not disclose the amount due to the confidential nature of the deal.

“I am pleased that this case has been resolved and appreciate the efforts West Virginia American Water has undertaken to further strengthen its systems providing fire service along with utilities across the state,” Cavendar said in an agreed-upon statement released by Hissam to WSAZ. .

WSAZ has reached out to West Virginia American Water for a comment. A spokesman said the company could not comment on litigation matters.
